This Terms of Service ("Terms") is a legal agreement between you and Flowtonik ("we," "us," or "our") regarding your use of the Flowtonik Digital Audio Workstation (DAW) for macOS and its associated services (collectively, the "Software").

By installing or using Flowtonik, you agree to be bound by these Terms.

1. License Grant

Flowtonik grants you a personal, non-exclusive, non-transferable license to install and use the Software on macOS devices that you own or control. This license is for your use as a music production tool, including the use of our integrated AI features.

2. The Flowtonik AI Pane

Flowtonik includes an "AI Pane" that allows for natural language interaction to assist in music generation, mixing, editing, and mastering.

• Third-Party Services: Flowtonik does not own the underlying AI models. We access music generation via ElevenLabs and natural language processing via services such as OpenAI, Google (Gemini), Anthropic Claude, or others.
• Pass-Through Terms: Your use of these AI features is subject to the terms and conditions of these third-party providers. By using the AI features in Flowtonik, you agree to comply with the ElevenLabs Terms of Use and the usage policies of the LLM provider (e.g., OpenAI’s Usage Policies).

3. Ownership and Commercial Use

• Your Content: You retain all ownership rights to the musical compositions, arrangements, and audio files you create using the Flowtonik DAW.
• Commercial Rights: Flowtonik imposes no restrictions on the commercial use of the music you create within the app. You are free to sell, stream, or distribute your music as you see fit.
• AI Output Limitation: While Flowtonik does not limit your commercial rights, your rights to AI-generated stems or content may be subject to the underlying terms of our API providers (such as ElevenLabs). It is your responsibility to ensure your intended use (e.g., commercial distribution) complies with those third-party licenses.

4. Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, or attempt to extract the source code of Flowtonik.
• Use the AI features to generate content that is illegal, defamatory, or infringes on the intellectual property rights of others.
• Use Flowtonik to "spam" or automate the creation of content in a way that violates the API limits of our third-party providers.
